Privacy Policy A ONE
The controller within the meaning of the GDPR is A EINS Business Intelligence GmbH. This information applies to data processing for which A EINS is independently responsible, in particular newsletters and registration for a trial access as a brand.
1. Party responsible for data processing
2nd Newsletter
If you sign up for our newsletter, we process your personal data for the purpose of regularly sending you information about our products, offers, news, and other content. As a rule, your email address, optionally your name (if you provide it), and other voluntary details are processed. The legal basis is your consent pursuant to Art. 6 para. 1 lit. a GDPR. If registration takes place using the double opt-in procedure, logging the registration and confirmation also serves as proof of your consent. With double opt-in, you will receive an email after registering in which you must verify your registration by clicking a confirmation link. Your registration only becomes effective after successful confirmation. Your data will be stored for sending the newsletter until you withdraw your consent or the mailing is discontinued. After a withdrawal, we will delete your data unless statutory retention requirements or other legal grounds prevent this. You can withdraw your consent at any time with effect for the future, for example via the unsubscribe link in each newsletter or by message to the contact details mentioned above. We may use an external shipping service provider to send the newsletter. If data is processed outside the EU or the EEA in this context, or if access possibilities exist, this will only take place under the conditions of Art. 44 et seq. GDPR, in particular through appropriate guarantees such as EU standard contractual clauses or on the basis of your consent, where required.
3. Registration
If you register for a trial account as a brand, we process your data to register your company on our SaaS platform, to set up access, to establish the prerequisites for a potential contract conclusion with your company, and to communicate with you as the contact person for your company. In particular, personal master data, such as first and last name, as well as business partner data, such as business contact details and company affiliation, are processed. The legal basis is Art. 6 para. 1 lit. b GDPR for the execution of pre-contractual measures, as the registration serves to initiate a contractual relationship with your company and enables access to the SaaS platform. We also process data on the basis of Art. 6 para. 1 lit. f GDPR due to our legitimate interest in business communication with you as a representative of the company. Your data will be transmitted to hosting and IT service providers insofaras this is necessary for the operation of the platform. There is no direct access by third parties; however, access from a third country may theoretically be possible within the scope of agreed services. A transfer to third countries only takes place if the level of data protection is secured by suitable guarantees pursuant to Art. 46 GDPR, standard contractual clauses, binding corporate rules, and/or an adequacy decision pursuant to Art. 45 GDPR, and data processing agreements pursuant to Art. 28 GDPR have been concluded. Personal data will only be stored for as long as is necessary for the respective processing purposes. If the registration account is deleted by the registered brand representative themselves or after the activation period has expired, deletion takes place immediately.
4. Your rights
In accordance with legal requirements, you have the right to access, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of any consent granted. To exercise your rights, you can contact us at the contact details provided above.
5. Right to object to processing based on legitimate interests
If we process data on the basis of Art. 6 (1) (f) GDPR, you have the right to object at any time for reasons arising from your particular situation.
6. Right to lodge a complaint with the supervisory authority
You have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement.
7. Obligation to provide data
The provision of personal data is neither legally nor contractually required, but may be necessary for certain functions of the website or platform. Without certain data, individual functions may not be usable.
8. Automated decision-making
Automated decision-making or profiling within the meaning of Art. 22 GDPR does not take place.
